How a title search is conducted

Five steps, in this order.

A search is only as good as the earliest document it reaches. The sequence matters, because each step tells you what to look for in the next.

Step 01

Collect the parent documents

The present deed, and every instrument behind it that the holder can produce.

Step 02

Search the register

Index II at the Sub-Registrar's office, matched against revenue and city survey records.

Step 03

Trace the devolution

Every transfer — sale, succession, partition, gift — reconciled into an unbroken chain.

Step 04

Test for encumbrance

Mortgages, charges, attachments, pending suits and statutory dues traced and verified as discharged.

Step 05

Report the findings

A written opinion stating whether the title is marketable, and precisely what qualifies it if it is not.

An advocate practising at Ahmedabad since 2017, with a practice centred on immovable property — its title, its transfer, and the disputes that follow both.

The chamber is a small one, and deliberately so. Property matters turn on documents that are decades old, often incomplete, and frequently contradictory. Reading them properly takes time that a large caseload does not allow. Every file is handled personally.

Work comes from property owners and buyers, developers, lenders and families dividing inherited land. What they have in common is a document that has to be right before anything else can happen.
